3.25 Million Dollar Settlement for Pedestrian Trucking Death
A 72-year-old father and husband was struck and killed by a semi-truck while walking on the side of the road in unincorporated Lakeland, Florida. The accident occurred at night, and evidence showed that the driver was on his cell phone when the crash occurred. The trucking company alleged the pedestrian was on the roadway and the accident was unavoidable. Evidence from the scene supported the pedestrian walking to the right of the fog line. The event data recorder showed the driver never reduced his speed before the impact and traveled over 1200 feet (or 4 football fields) before stopping. We argued this was a preventable crash caused by the driver’s inattentiveness. A lawsuit for negligence was brought against the driver and his employer on behalf of the Decedent’s elderly widow and adult children. The lawsuit was resolved with a 3.25 million Dollar Settlement.
